Welcome to Bloom!
These Terms of Service ("Terms") govern your use of the Bloom mobile application and any related services (collectively, the "Service") provided by Bloom Inc. ("we," "us," or "our"). By accessing, downloading, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1. Our Service
Bloom is a peer-to-peer (P2P), end-to-end encrypted photo and video sharing application designed with privacy as our core principle. Our Service enables you to:
- Share photos and videos directly with trusted contacts through encrypted, device-to-device transmission
- Create and participate in private groups for collaborative photo sharing
- Engage socially through likes, comments, and reactions within secure, encrypted environments
- Utilize on-device AI features to organize and enhance your photo experience without compromising privacy
We do not store your photos, videos, or messages on our servers. All content is transmitted directly between user devices using end-to-end encryption.
2. Eligibility
You must be at least 13 years old to use Bloom. By agreeing to these Terms, you represent and warrant that:
- You are at least 13 years of age
- You have the legal capacity to enter into a binding agreement
- You are not prohibited from using the Service under applicable laws
- If you are between 13 and 18 years old (or the age of legal majority in your jurisdiction), you have obtained parental or guardian consent
3. Your Account
To use Bloom, you will need to create an account. When you create an account:
- Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account
- Accurate Information: You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate
- Account Responsibility: You are solely responsible for any activities or actions under your account, whether or not authorized by you
- Unauthorized Access: You must immediately notify us of any unauthorized use of your account or any other breach of security
- Account Transfer: You may not transfer, sell, or otherwise assign your account to any other person or entity
4. User Content and Ownership
4.1 Your Ownership Rights
You retain full and complete ownership of all photos, videos, comments, messages, and other content you create, upload, or share through the Service ("User Content"). Bloom does not claim any ownership rights to your User Content.
4.2 Limited License Grant
By using Bloom, you grant us a limited, non-exclusive, royalty-free, worldwide license solely to:
- Facilitate the encrypted, peer-to-peer transmission of your User Content to your intended recipients
- Enable the technical operation of the Service, including device-to-device data transfer
- Process your User Content on your local device for on-device AI features
This license automatically terminates when you delete your User Content from the Service.
4.3 Your Responsibilities
You are solely responsible for your User Content and the consequences of sharing it. You represent and warrant that:
- You own or have obtained all necessary rights, licenses, consents, and permissions to share your User Content
- Your User Content does not violate any third-party rights, including copyright, trademark, privacy, publicity, or other personal or proprietary rights
- Your User Content complies with these Terms and all applicable laws and regulations
4.4 Content Control Features
Bloom provides you with granular control over your shared content:
- Forwarding Control: You can disable forwarding on any photo or video you share, preventing recipients from resharing it
- Delete for Everyone: You can delete your content from all recipient devices at any time. When you delete content, deletion requests are sent to all devices that received it
- Group Permissions: You can manage who has access to your content within private groups
5. Acceptable Use Policy
5.1 Prohibited Activities
You agree not to use the Service to engage in, promote, or facilitate any of the following:
- Illegal Content: Share content that is unlawful, fraudulent, or violates any applicable laws or regulations
- Harmful Content: Share content that is harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable
- Minors: Share any content that exploits, harms, or attempts to exploit or harm minors in any way
- Intellectual Property: Infringe upon the intellectual property rights, privacy rights, or other rights of any third party
- Impersonation: Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
- Malicious Code: Upload, transmit, or distribute any viruses, malware, ransomware, spyware, or other malicious code
- Spam: Send unsolicited or unauthorized advertising, promotional materials, spam, or any form of solicitation
5.2 Prohibited Technical Activities
You agree not to:
- Reverse-engineer, decompile, disassemble, or otherwise attempt to discover the source code of the application
- Modify, adapt, translate, or create derivative works based on the Service
- Interfere with or disrupt the integrity or performance of the Service or the data contained therein
- Attempt to gain unauthorized access to any portion of the Service, other accounts, or any systems or networks connected to the Service
- Use any automated system, including robots, spiders, or scrapers, to access the Service
- Circumvent, disable, or interfere with security-related features or features that prevent or restrict use or copying of any content
6. Peer-to-Peer Architecture and Data Transmission
Bloom operates on a peer-to-peer architecture. This means:
- Direct Transmission: Your content is transmitted directly from your device to recipient devices without intermediate server storage
- Network Requirements: The Service requires an active internet connection for real-time sharing. Both sender and recipient devices must be online for immediate transmission
- Device Storage: Your shared and received content is stored locally on your device and on recipient devices, not on our servers
- Encryption: All transmissions are end-to-end encrypted, meaning only the sender and intended recipients can decrypt and view the content
7. On-Device AI Features
Bloom includes Smart AI Feed features that operate entirely on your device:
- Local Processing: All AI analysis, photo organization, and feed generation occur exclusively on your device
- No Data Transmission: No photos, metadata, or AI processing results are transmitted to our servers or any third-party services
- User Control: You can enable or disable AI features at any time in your device settings
8. Intellectual Property Rights
8.1 Bloom's Intellectual Property
The Service, including its software, design, text, graphics, logos, icons, and other content (excluding User Content), is owned by Bloom Inc. and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service solely for your personal, non-commercial purposes.
8.2 Trademarks
Bloom, the Bloom logo, and other Bloom marks are trademarks of Bloom Inc. You may not use these trademarks without our prior written permission.
8.3 Copyright Infringement
We respect the intellectual property rights of others. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement through the Service, please provide us with the following information:
- A description of the copyrighted work you claim has been infringed
- A description of where the allegedly infringing material is located within the Service
- Your contact information, including address, telephone number, and email
- A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf
9. Privacy and Data Protection
Your privacy is fundamental to Bloom. Please review our Privacy Policy to understand how we handle information. Key privacy principles include:
- We do not have access to your encrypted photos, videos, or messages
- We do not store your media content on our servers
- We collect minimal account and technical information necessary to operate the Service
- We do not sell, rent, or share your personal information with third parties for their marketing purposes
10. Third-Party Services and Links
The Service may contain links to third-party websites, applications, or services that are not owned or controlled by Bloom. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party services. You acknowledge and agree that Bloom shall not be responsible or liable for any damage or loss caused by your use of any third-party services.
11. Termination
11.1 Termination by You
You may stop using the Service and delete your account at any time through the app settings. Upon account deletion:
- Your account information will be removed from our systems
- Content stored on your device will remain until you manually delete it
- Content you shared that exists on recipient devices will remain subject to those recipients' control
11.2 Termination by Us
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:
- Violation of these Terms
- Fraudulent, abusive, or illegal activity
- At our sole discretion if we determine that your use of the Service poses a risk to us, other users, or third parties
Upon termination for any reason, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
12. Disclaimers and Limitation of Liability
12.1 Service "As Is"
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
BLOOM INC. DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- • MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
- • THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
- • THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS
- • THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT OR INFORMATION OBTAINED THROUGH THE SERVICE
- • THAT DEFECTS WILL BE CORRECTED
12.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BLOOM INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY:
- • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- • LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
- • DAMAGES RESULTING FROM YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SERVICE
- • UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA
- • STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE
- • ANY OTHER MATTER RELATING TO THE SERVICE
WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT BLOOM HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
12.3 Limitation Amount
IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, BLOOM'S LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. IN NO EVENT SHALL BLOOM'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT OF ONE HUNDRED DOLLARS ($100.00).
13. Indemnification
You agree to defend, indemnify, and hold harmless Bloom Inc., its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of these Terms
- Your use of the Service, including any data or content transmitted or received by you
- Your User Content
- Your violation of any rights of another party, including any intellectual property rights, privacy rights, or publicity rights
- Your violation of any applicable law, rule, or regulation
14. Dispute Resolution and Arbitration
14.1 Informal Resolution
Before filing a claim, you agree to try to resolve the dispute informally by contacting us. We'll try to resolve the dispute informally by contacting you via email.
14.2 Binding Arbitration
If the parties are unable to resolve the dispute through informal negotiation, any remaining dispute shall be resolved through binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. The arbitration shall be conducted in English and shall take place in [Your Jurisdiction].
14.3 Class Action Waiver
You and Bloom agree that any proceedings to resolve disputes will be conducted solely on an individual basis and not in a class, consolidated, or representative action.
15. Governing Law and Jurisdiction

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, please stop using the Service.
17. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired.
18. Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and Bloom Inc. concerning the Service and supersede all prior agreements and understandings.
